         มาตรา ๓๔๒*  ถ้าในการกระทำความผิดฐานฉ้อโกง ผู้กระทำ

        (๑) แสดงตนเป็นคนอื่น หรือ

        (๒) อาศัยความเบาปัญญาของผู้ถูกหลอกลวงซึ่งเป็นเด็ก หรืออาศัยความอ่อนแอแห่งจิตของผู้ถูกหลอกลวง

        ผู้กระทำต้องระวางโทษจำคุกไม่เกินห้าปี หรือปรับไม่เกินหนึ่งแสนบาท หรือทั้งจำทั้งปรับ

Unofficial Translation

        Section 342. If, in the commission of an offense of defrauding, the perpetrator:

         (1) poses as another person; or

        (2) takes advantage of the lack of intelligence of the swindled person who is a child or takes advantage of the weakness of mind of the swindled person,

         the perpetrator shall be liable to imprisonment for a term not exceeding five years or to a fine not exceeding one hundred thousand baht or both.
